Terms of Service
1. Order Instructions:
Photo Orders: Customers must provide Virtuous Graphics with notice as to how exactly the customer wants the photographs taken. Notice must be made in writing via email. Oftentimes customers provide a few of the best photos of some of their competitors for us to imitate and improve upon. In the event the customer does not provide specific instruction within 24hrs of purchase, our photographer reserves the right to use their best judgment in taking the photos.
2. Add on Services:
Photo Orders: Customers that require lifestyle photos, or model photos must email Virtuous Graphics prior to placing their order for a custom quote (don’t worry our prices are very economical). Customers that require an oversized product must email prior to ordering to ensure Virtuous Graphics can photograph the item. Oversized products include products with a length, width, or height over 2 feet.
3. Approval & Revisions:
Photo Orders: The customer reserves the right to inspect a post processed version of the photo and approve the order. In the event a customer disapproves of some of the photos, Virtuous Graphics shall provide a single complimentary re-photograph or re-touching. In doing so, the customer must be very clear & specific as to the changes required. The customer must make the approval in writing by email. In the event the customer still disapproves of the photos after the complimentary revision, Virtuous Graphics reserves the right to terminate the order, issue a full refund, and deny future service offerings. If no approval or disapproval is provided within 48hrs of receiving the post processed image from Virtuous Graphics, approval will be presumed and the order will be fulfilled.
Graphic Design Orders: The customer reserves the right to inspect a post processed version of the graphic design and approve the order. In the event that the customer still disapproves of the photos after the complimentary revision, Virtuous Graphics reserves the right to terminate the order, issue a full refund, and deny future service offerings.
If no approval or disapproval is provided within 48hrs of receiving the post processed graphic from Virtuous Graphics, approval will be presumed, and the order will be fulfilled.
4. Product Quality & Resulting Image:
Photo Orders: Virtuous Graphics is not responsible for flaws in the product photographed. Virtuous Graphics will photograph the item as it arrives at the studio. If the item has flaws, mis-labels, “waves” in the labels, nicks in the package or products, inherent damage, it will be photographed as such. If the item arrives unacceptably damaged as determined by our receivables department, you will be contacted and given a chance to send a new item to be photographed.
Virtuous Graphics may retouch certain minor flaws inherent in the product, but this is not required.
5. Accepting Work / Right of Refusal:
In the event Virtuous Graphics is unable to fulfill an order request, Virtuous Graphics reserves the right to refund your order in full within 5 business days of accepting an order.
6. Prohibited items:
Virtuous Graphics will not photograph any prohibited items. Under no circumstances may a customer deliver to us any merchandise that contains, any narcotic, illegal drug, or controlled substance, or any dangerous weapon, firearm, explosive, dangerous chemical, obscene or pornographic materials or any merchandise.
7. Turn Around Time:
Photo orders: The turnaround time for photo orders is 12 business days from the time we receive the customer’s product and instructions in full or within 12 business days of any additional instructions and clarifications requested by the customer during the turnaround time.
Please note, the turnaround time may exceed 12 days in the even Virtuous Graphics requires your cooperation or response in order to complete the photo order.
Graphic Design Orders: The turnaround time for graphic design orders is 7 business days or less from the time we receive your complete order instructions or within 7 business days of any additional instructions and clarifications requested by the customer during the turnaround time. If you require a faster turnaround time we recommend you upgrade to the rush delivery option.
Design & Copywriting Orders: The turnaround time for design and copywriting orders is 9 business days from the time we receive your product and instructions in full or within 9 business days of any additional instructions and clarifications requested by the customer during the turnaround time. Please note, the turnaround time may exceed 9 days in the even Virtuous Graphics requires your cooperation or response in order to complete the design and copywriting order.
Video Orders: The turnaround time for video orders is 15 business days from the time we receive your product and instructions in full or within 15 business days of any additional instructions and clarifications requested by the customer during the turnaround time. Please note, the turnaround time may exceed 15 days in the even Virtuous Graphics requires your cooperation or response in order to complete the video order.
Post initial deliverable, in the event the customer requests a revision, a design revision will take 3 business days; and a photo reshoot revision will take 5 business day (longer if model and /or venue needs to be booked).
Reshoots and edits: During the review period the customer may contact Virtuous Graphics to request changes to the Content such as reshoots, edits, or additional photos. Upon request, we will reshoot or edit photos free of charge under the following circumstances:
- Work not completed as specified on the invoice and accompanying shot list. If Virtuous Graphics makes an error and delivers work that is not correct as specified on the invoice and its accompanying shot list, Virtuous Graphics will reshoot or edit the work, as needed, to correct the error.
- Customer requests images to be edited. If the customer sees anything in the Content that the customer would like Virtuous Graphics to touch-up, Virtuous Graphics will perform (1) round of editing, free of charge, at your request to further adjust details such as color, tone, minor blemishes, and any other adjustments that can be made without reshooting the Content.
Some change requests made during the review period may require an additional charge. Examples include:
Additional photos: If the customer requests additional photos that were not previously included on the invoice, we will inform you of the cost and request payment prior to completion of the work.
Reshoots: If we’ve photographed images as they are described on the invoice but you’d like to see them changed, such as different lighting, camera angle, arrangement, or anything else that requires them to be re-shot, then we may, at our option, quote an additional charge to cover the cost of reshooting them.
Note, the customer has 7 days from the time deliverables are emailed to provide feedback and revisions. If no response is provided, then Virtuous Graphics will assume the work is satisfactory and delivered in full. To re-start the order past the 7 day turnaround time may require an added cost and the product will be disposed of within 14 which will require the customer start a new order with Virtuous Graphics and cover cost of new ship label + applicable duties.
All sales are final. Payments made to us are not refundable unless Virtuous Graphics has failed to uphold a responsibility specified within these terms of services. In the event Virtuous Sellers fails to uphold their responsibility under these terms of services, a refund will be processed via the same method as the payment was made. Credit card payments will be refunded to the same card payment was made. Payments by check will be refunded by company check.
Virtuous Graphics reserves the right to make changes to the prices we charge for our services at any time by publishing the new rates to our Website. Virtuous Graphics may offer other services that aren’t listed on our pricing page and, if applicable, those rates will be disclosed prior to work being performed. Virtuous Graphics assumes no liability to the customer or to any third-party for any modifications or price changes.
The Client must pay 100% of the costs up front through the website for orders less than 100 products. With the exception of video orders, the customer must pay 100% upfront of their bill before we start all other orders. For video orders, we allow 50/50 payment terms, 50% upfront and 50% upon delivery. In the event the customer has an outstanding bill, we reserve the right to take legal action, hold back deliverables, watermark images, and any other actions necessary until payment is received.
It’s up to the customer, to always check deliverables and ensure that they’re Terms of Service compliant for the platform they’re uploading the work to. To the fullest extent of the law, the customer shall indemnify, defend and hold harmless Virtuous Graphics, its officers, employees, agents, representatives, consultants, and contractors from and against any and all loss, costs, penalties, fines, damages, claims, expenses including attorney’s fees) or liabilities arising out of, resulting from, or in connection with the services offered by Virtuous Graphics or by customer’s violation of any law or the rights of a third-party.
15. Shipping & Duties:
Customer is responsible for the shipping charge from their location to the Philippines, as well as any duties local customs charges is to be passed onto the customer. On tier 3 photo orders we provide a $40USD credit to the label that can be credited off the total bill. It is not the responsibility of Virtuous Graphics to pay for the cost of the duties for your product. If you wish to know the duty rate, you’ll need to email us before shipping your product to get a duty quote/ estimate.
Photo Orders: The customer is responsible for the cost of shipping the product to the photo studio. Moreover, due to high shipping costs to ship a product from our location in Asia to USA, we will by default safely dispose of your product after you have approved the photographs we have provided. Should your product be expensive, and you prefer to get it shipped back to you, you’ll need to email us within 24 hours of purchase, and we’ll quote you on the return shipping prices according to weight and shipping destination. If you don’t email us within 24hrs of purchase, we’ll by default safely dispose of the product.
16. Return Shipping:
Please note, we do not return the product provided for photographs. The customer is aware that when shipping us the product, it will be disposed of after the order complete.
17. Product Disposal:
We only hold the product for 14 days post order deliverables being sent to customer. If no revisions is requested by the customer within 14 days, we will dispose of the product.
Should you be un-willing or unable to provide the necessary information required in-depth to complete an order, we reserve the right to cancel & refund the order as well as to deny future service offerings to you as a client. Any dispute regarding this agreement shall be, at Virtuous Graphics sole discretion, either (1) arbitrated in Florida under the rules of the American Arbitration Association and the laws of Florida. Judgment on the arbitration award may be entered in any court having jurisdiction. Any dispute involving $2,500 or less may be submitted without arbitration to any court having jurisdiction thereof. The client shall pay all arbitration and court costs, Virtuous Graphics reasonable legal fees, and expenses, and legal interest of any award or judgment in the event of any ward or judgment in favor of Virtuous Graphics., or (2) adjudicated in Florida under the laws of Florida. The Client shall pay all court costs, the Photographer’s legal fees, and expenses, and legal interest on any award or judgment in the event of any award or judgment in favor for Virtuous Graphics.
